Argentina launches a central beneficial owner register
Argentina's federal tax authority (then AFIP, now ARCA) set up the Centralised Public Register of Beneficial Owners by General Resolution 5529/2024, in force from 19 July 2024. A beneficial owner is an individual holding at least 10% of the capital or votes of an entity, or exercising final control by other means. The register draws on existing reporting regimes. Access is limited to authorities and, for their own data, the entities and individuals concerned.
Law 27,739 of 2024 updated Argentina's anti-money laundering law and provided for a central register of beneficial owners. General Resolution 5529/2024 implements it.
What changed
- Register: the tax authority runs a central register of beneficial owners, built from information companies and trusts already file, such as the annual regime for corporate operations and authorities.
- Beneficial owner: an individual holding at least 10% of the shares or votes, or exercising final control by other means.
- Full access: prosecutors, courts, the financial intelligence unit (UIF), the Central Bank, the securities regulator (CNV), the insurance regulator, public registries and other oversight bodies.
- Limited access: entities can see their own beneficial owners' data and share it with obliged parties on request. Individuals can see their own data.
- In October 2024 AFIP was replaced by the Agency for Collection and Control of Customs (ARCA), which now runs the register.
